Terms of Use
Version 1.2 · Effective from 10/19/2026
Courtesy translation. In case of discrepancy, the Portuguese version prevails (choose Português in the language selector at the bottom of the page).
1. Acceptance. By accessing Patentiq, you accept these Terms. Use by customers also follows the service agreement signed with PATENTIQ TECNOLOGIA LTDA. In case of conflict, the agreement prevails.
2. The service. Patentiq monitors the internet for domains, profiles, images and ads that may misuse the customer's brand; keeps evidence; suggests the level of risk; and supports removal requests.
3. Accounts and access. Access is by invitation. You are responsible for keeping your password confidential, not sharing your account, and notifying Patentiq if you suspect misuse. The customer's administrator is responsible for the users they invite.
4. Permitted use. It is forbidden to:
- use the platform for unlawful purposes or to harass, expose or intimidate people;
- monitor brands over which the customer has no rights or authorization;
- try to access other customers' data, bypass security controls or overload the system;
- copy, resell or reverse engineer the platform.
5. Customer responsibility for brands. The customer declares that it owns or is authorized to protect the registered brands and is liable for removal requests made at its request.
6. Nature of the results. Results, risk scores and artificial intelligence suggestions support decisions and may contain errors. The final classification and the decision to request removal belong to the customer. Patentiq does not guarantee that every misuse will be found or that every removal will be accepted by the third-party platform or provider.
7. Evidence. Evidence receives an integrity code and a timestamp, which help prove when and how the content was seen. It does not replace a notarial record (ata notarial) when the law or the case requires one.
8. Intellectual property. The platform, its brand and its code belong to PATENTIQ TECNOLOGIA LTDA. The customer's data and brands remain the customer's.
9. Availability. We strive to keep the service available, but interruptions may occur for maintenance or due to third-party failures. Specific service levels, when applicable, are set out in the agreement.
10. Limitation of liability. To the maximum extent permitted by law, Patentiq is not liable for lost profits or indirect damages. Total liability is limited to the amount paid by the customer in the 12 months before the event, except in cases of willful misconduct or gross negligence.
11. Suspension and termination. Patentiq may suspend access in case of breach of these Terms or non-payment, according to the agreement. At the end of the agreement, data follows the periods in the Privacy Policy.
12. Privacy. Processing of personal data follows the Privacy Policy and the Cookie Policy.
13. Changes. We may update these Terms. Relevant changes will be announced on the platform before they take effect.
14. Law and venue. These Terms are governed by the laws of Brazil. The courts of Curitiba/PR are chosen as the venue, unless a different legal rule applies.
15. Takedown service.
- When contracted, the takedown service allows the master user to ask Patentiq to notify third parties (domain registrars, hosting providers, platforms and social networks) to remove or suspend content that infringes the customer's brand rights.
- By requesting a takedown, the master declares that they are authorized to represent the customer and authorizes Patentiq to act on the customer's behalf for that target. The authorization is recorded with date, time, user and IP address.
- Patentiq sends the notices with the collected evidence and follows up on the responses, but removal depends solely on the decision of the notified third party. Patentiq does not guarantee the outcome.
- Patentiq may decline a request that lacks sufficient grounds or that could expose the customer to risk, stating the reason.
- Legal actions and administrative proceedings with their own costs (such as SACI-Adm) are not part of the service and require a specific quote and agreement.
- The customer acknowledges that some notified third parties forward the notice to the reported party or publish it in public transparency databases, such as Lumen, and that the notice contains the company name and CNPJ of the customer or of the brand owner. Patentiq notifies with its own name and the email takedown@patentiq.com.br, without using the personal data of the customer's users; on the case page, the customer sees when the channel used may forward or publish the notice.
